Advertising terms

Version 1.0. Effective from the date of publication on the site.

1. General provisions

1.1. These terms set out how advertising is placed on pesticidy.ge (the “Site”). Contractor: pesticidy.ge (the “Administration”). Customer: a company or individual entrepreneur registered on the Site as an advertiser (the “Advertiser”).

1.2. By submitting an order through the account, the Advertiser confirms that it has read and accepts these terms. The contract is concluded when the issued invoice is paid.

1.3. Matters not covered by these terms are governed by the Terms of use and the legislation of Georgia.

2. Advertiser registration

2.1. To order advertising, a company registers on the “Become an advertiser” page, providing its name, identification code, contact person, phone and e-mail.

2.2. The Administration verifies the data and confirms or rejects the registration; the Advertiser is notified by e-mail. The Administration may refuse without giving reasons.

3. Placements and prices

3.1. Placements, formats, banner sizes and prices are listed on the “Advertising” page and in the order form. The price in effect on the date the order is submitted applies.

3.2. Prices are in Georgian lari (GEL). Taxes are shown in the invoice in accordance with the tax legislation of Georgia.

3.3. Advertising is targeted to catalogue sections and crops as selected in the order.

4. Ordering and payment

  1. In the account, the Advertiser selects the placement, sections or crops and display period, and uploads the materials.
  2. The Administration reviews the order and materials and either issues an invoice or rejects the order, stating the reason.
  3. The Advertiser pays the invoice by bank transfer to the details stated in it within 5 banking days. An invoice not paid on time may be cancelled.
  4. Display starts on the start date stated in the order, but not before payment is received. If payment arrives after the start date, the display period is postponed or shortened by agreement.
  5. Display stops automatically at the end of the paid period.

5. Requirements for advertising materials

5.1. Materials must comply with the legislation of Georgia, including on advertising and on pesticides and agrochemicals, and must be truthful and not misleading.

5.2. Advertising of products not registered in Georgia is prohibited, as is information on use that contradicts the approved regulations and the product label.

5.3. Claims that a product is completely safe or harmless to people, animals, bees or the environment are not allowed unless confirmed by official documents.

5.4. The Advertiser warrants that it holds the rights to the trademarks, images and texts used, and is solely responsible to third parties for their content.

5.5. Banner files must match the formats and sizes stated in the order form. A banner may only link to the Advertiser’s own site or page.

5.6. The Administration may reject materials or request changes, and may suspend display if materials breach these requirements or a justified complaint is received.

6. Statistics

Banner impressions and clicks are shown in the Advertiser’s account. Statistics are for information only; payment is for the placement period, not for impressions or clicks.

7. Cancellation and refunds

  • An order can be cancelled in the account before payment at no cost.
  • If a paid order is cancelled before display starts, the payment is refunded in full.
  • After display starts, no refund is given for the elapsed period; a refund for the unused period is subject to agreement.
  • If display is stopped because the Advertiser breached section 5, payment for the remaining period is not refunded.
  • If display is interrupted through the Administration’s fault for more than 24 consecutive hours, the display period is extended by the length of the interruption.

8. Documents

The invoice is available in the Advertiser’s account (“Invoices”). The tax invoice is issued through the Revenue Service of Georgia portal (rs.ge) and attached to the order in the account.

9. Liability

9.1. The Advertiser is responsible for the content of the advertising and its compliance with the law. If claims are made against the Administration in connection with the Advertiser’s advertising, the Advertiser settles them itself and reimburses the Administration’s costs.

9.2. The Administration’s liability for each order is limited to the amount paid for that order, to the extent permitted by the legislation of Georgia.

10. Personal data

Data of the Advertiser’s contact persons is processed in accordance with the Privacy policy.

11. Changes and disputes

11.1. The Administration may change these terms; orders already paid are governed by the version in effect on the date the order was submitted.

11.2. Relations between the parties are governed by the legislation of Georgia. Disputes are resolved through negotiation and, failing agreement, by a court of Georgia at the location of the Administration.
